Morgan & Morgan Review: Contingency Fees and Alternatives
Morgan & Morgan works on contingency with no upfront fees. How its fee is set, Florida caps, and how it compares with Sokolove Law and Weitz & Luxenberg.
Morgan & Morgan is a good first call for an injury, workers' compensation or disability claim if you want a large firm with an office near you. At Lawfare Claims, we built this Morgan & Morgan review from the firm's own fee pages and profile, then checked three other national plaintiff firms against it.
Morgan & Morgan works on contingency, so you pay no fee unless the firm recovers money for you. Founded in 1988, it reports more than 1,100 attorneys and about 140 offices as of October 2026, and it markets itself as America's largest injury law firm.
Morgan & Morgan Review Verdict: Who Should Call
Morgan & Morgan is worth a call for car crashes, slip and fall injuries, workers' compensation, Social Security Disability and many consumer claims. Its strengths are reach and access. The firm says it has attorneys ready in all 50 states, takes calls 24/7, and gives clients an app to follow their case.
Our recommendation comes with one condition. Get the fee percentage, any increase if the case goes to trial, and the treatment of case costs in writing before you sign. Morgan & Morgan's fee guide says the percentage can vary by location and by whether the claim goes to trial, so two clients can sign different terms.
Morgan & Morgan is a weaker fit for three groups:
- People with a mesothelioma or asbestos claim, who should also talk to a firm that centers its practice on those cases, such as Weitz & Luxenberg or Sokolove Law.
- People with a small property-damage dispute, where small claims court or another option without a lawyer may cost less than any contingency fee.
- People who need help outside injury and claims work. Check the Morgan & Morgan practice areas list before you call about a will, a divorce or a criminal charge.
Our answer would change if Morgan & Morgan published a standard fee schedule that came in above the rates local firms quote in your state. It would also change if a local firm offered you a lower percentage in writing with the same cost terms.
Morgan & Morgan Fees and How the Percentage Is Set
Morgan & Morgan charges a contingency fee, which is a percentage of the settlement or verdict, and it charges nothing if the case does not succeed. The firm's slogan is "The Fee Is Free," and its frequently asked questions (FAQ) page on fees says there are no upfront fees or expenses until the case ends in a recovery.
The firm does not publish a set percentage. Its fee guide lists four factors that move the number:
- Location. State rules and local practice affect the rate in the retainer agreement.
- Trial. The percentage can change if the claim goes to trial, so ask for the trial rate as well as the settlement rate.
- Case type. Some claims, such as workers' compensation, have fee percentages set by law, which limits what any firm can charge.
- Award size. The percentage may drop once an award passes a set amount, which matters most on large recoveries.
Case costs are separate from the fee. Medical records, court filing fees and expert witnesses appear as deductions on the closing statement. Morgan & Morgan says clients owe nothing if the case is unsuccessful.
At the end of a case, the firm prepares a closing statement that lists the award, the fee and each cost. You and the attorney both sign it. The fee guide says funds are typically available 7 to 10 business days after signing.
Florida Fee Limits Apply to Florida Cases
Morgan & Morgan lists its main address in Orlando, and Florida injury cases follow Rule 4-1.5(f)(4)(B) of the Rules Regulating The Florida Bar. The standard maximum is 33 1/3% of a recovery up to $1 million if the case settles before the defendant answers the lawsuit. After that point, the standard maximum rises to 40% of a recovery up to $1 million.
The step from 33 1/3% to 40% changes your share. The table uses a hypothetical $90,000 recovery with $5,000 in case costs and the fee figured on the full recovery.
| Fee Rate | Attorney Fee | Case Costs | Amount to You |
|---|---|---|---|
| 33 1/3% (Florida standard maximum before the defendant answers) | $30,000 | $5,000 | $55,000 |
| 40% (Florida standard maximum after the defendant answers) | $36,000 | $5,000 | $49,000 |
In this example the later rate costs you $6,000. Ask whether costs come out before or after the fee is calculated, because taking costs out first lowers the fee. Our contingency fee guide walks through that math, and the contingency vs hourly comparison shows when an hourly lawyer costs less.
What Morgan & Morgan Is and Who It Serves
Morgan & Morgan is a plaintiff-side law firm, which means it represents people and businesses bringing claims, usually against insurers, employers or companies. John and Ultima Morgan founded it in 1988. The firm's about page says it has recovered more than $35 billion for more than 700,000 clients, a firm-reported figure that does not predict the result of any one case.
The firm lists more than 50 case types. The most common ones fall into four groups:
- Injury claims: car, truck and motorcycle crashes, slip and fall injuries, medical malpractice, nursing home abuse and wrongful death.
- Work and benefits claims: workers' compensation and Social Security Disability.
- Product and exposure claims: mesothelioma and other mass tort cases against drug and product makers.
- Group claims: class actions and other complex cases.
Morgan & Morgan also runs ClassAction.com, which lists open lawsuits and settlements with a free case review form. The ClassAction.com footer names Morgan & Morgan, PA (a professional association) as the owner. A case review submitted there goes to the same firm, so you do not get a second opinion by using both.
Benefits of Hiring Morgan & Morgan
Morgan & Morgan's main benefits are local offices, all-hours intake, a client app and no upfront fees or expenses.
- No upfront cost. You pay no retainer, so a client without savings can still hire a lawyer after an injury.
- Around-the-clock intake. The firm takes calls 24/7, so you can start a claim the night of a crash instead of waiting for business hours.
- About 140 offices. A nearby office makes in-person meetings and document drop-offs easier for clients who prefer them.
- Case tracking app. The M&M Mobile app listing says clients can view case status, see documents the legal team shares and message their attorney. That cuts down on phone calls to ask about progress.
- Spanish-language help. The firm links to a Spanish-language site, Abogados.com, so Spanish-speaking clients can start in their own language.
- Large group cases. The firm's history includes a $1.25 billion settlement in 2010 in a discrimination case brought by Black farmers, which shows it takes on cases against large defendants.
The firm says it has more than 150,000 five-star reviews. Reviews describe service quality. They do not measure what your claim is worth.

Sokolove Law was founded by Jim Sokolove in Boston in 1979 and says it has helped people in all 50 states. Its about page says that in most cases it co-counsels with other attorneys for principal responsibility. If you sign with Sokolove Law, ask which firm will handle your case day to day.
Weitz & Luxenberg was founded by Perry Weitz and Arthur M. Luxenberg and is headquartered in New York. It represents clients from all 50 states, and its FAQ says it works on a contingency basis. Its practice leans toward asbestos, defective drugs and environmental cases, which makes it a strong second call for exposure claims.
Lieff Cabraser was founded by Robert L. Lieff in 1972. The firm says its lawyers represent clients in individual, group and class action lawsuits in federal courts nationwide. In a class action, the court decides the attorney fee as part of approving the settlement, as our guide to how class action settlements work explains.
Choose Morgan & Morgan when your claim is a common injury or benefits case and you value a local office. Choose Weitz & Luxenberg or Sokolove Law when the claim is asbestos or drug exposure. Choose Lieff Cabraser when you want to bring or lead a class action.
Drawbacks to Weigh
Morgan & Morgan's main drawback is that you cannot compare its price before you call, because the firm does not publish its fee percentage.
- No public rate. Ask for the percentage in writing at the first meeting so you can compare it with a local firm's quote.
- Rate can rise at trial. Ask for both the settlement rate and the trial rate before you sign.
- Large-firm staffing. With more than 1,100 attorneys, your case goes to one local team out of many. Ask who your attorney and case manager will be, and how to reach them.
- Case costs reduce your share. Ask for an estimate of likely costs and whether they come out before or after the fee.
- Not every case is accepted. A free case evaluation does not mean the firm will take the claim. If it declines, ask why, then contact another firm before your filing deadline passes.
Settlement timing also varies by claim. Our guide on how long a settlement takes covers the stages between signing a release and receiving payment.

The same questions work for any contingency firm. For wrongful death claims, our guide to wrongful death lawyer fees adds the state fee caps that apply.
