What the Comcast Data Breach Settlement Pays
The Comcast data breach settlement offers four kinds of benefits paid from a single $117.5 million fund. Administration costs and attorneys' fees also come out of that fund.
| Item | Amount | Notes |
|---|---|---|
| Alternative cash payment | Estimated at about $50 | No documentation needed; the amount can rise or fall based on the number of valid claims |
| Documented out-of-pocket losses | Up to $10,000 | Examples include identity theft, fraud, credit monitoring and credit freezes |
| Lost time | $30 per hour, up to 5 hours | 5 hours at $30 per hour equals a $150 maximum |
| Identity protection services | Not stated as a dollar figure | Listed as a settlement benefit |
The $50 figure is an estimate. The amount can rise or fall depending on the number of valid claims.
The exact amount any one person will receive is unknown. It depends on the final count of valid claims and on the costs paid from the fund.
Who Was Included in the Xfinity Data Breach Settlement
The Xfinity data breach settlement class is people who received a Comcast notice that their information may have been compromised in the October 2023 breach. Being an Xfinity customer is not enough on its own. A former customer who got the notice can qualify.
Unauthorized access to Comcast's systems happened between October 16 and 19, 2023. Comcast disclosed the breach in December 2023. Reports say tens of millions of consumers were affected, though we found no exact count in the reports we reviewed.
This breach is separate from breaches at other telecom companies. AT&T has its own settlement, covered in our guide to the AT&T data breach settlement.
Kroll Settlement Administration LLC is the settlement administrator, and the official settlement website is ComcastBreachSettlement.com. The reported phone number for the settlement is (833) 319-2401.
Deadlines and Court Approval
Every deadline for filing a claim in the Comcast case has passed. Online claims were due by 11:59 p.m. Eastern Time (ET) on September 14, 2026, and mailed forms had to be postmarked by that date. Earlier reporting gave August 14, 2026 as the deadline, but the September 14 date replaced it.
| Date | What Happened |
|---|---|
| October 16 to 19, 2023 | Unauthorized access to Comcast's systems |
| December 2023 | Comcast disclosed the breach |
| August 5, 2026 | Final approval hearing held |
| August 14, 2026 | Earlier reported claim deadline, later replaced |
| August 20, 2026 | Reported date Judge John M. Younge approved the settlement |
| September 14, 2026 | Claim deadline (11:59 p.m. ET online; postmark date for mail) |
| About September 19, 2026 | End of the 30-day federal appeal window; would be about September 19, 2026 if the reported approval date is right |
If you saw the August 14 date on an old article, that page is out of date. The September 14 date superseded it.
When Payments Are Expected
No date for Comcast data breach settlement payments had been announced in the reports we reviewed. Payments depend on the settlement's "Effective Date." That date requires the 30-day federal appeal window after the reported August 20 judgment to close, or any appeal to be resolved.
If the reported August 20 approval date is right, the appeal window would have ended around September 19, 2026. We do not know whether anyone filed an appeal. If an appeal was filed, payments wait until it is resolved.
Some websites say payments "should have started" already. The more detailed reports say payments have not started. We are not predicting a payout date, because no source we reviewed gave one.
Attorneys' fees also come out of the fund. Reports say the judge cut about $7 million from class counsel's fee request, and one report puts the cut at $7.4 million. A separate report puts the fee award at $31.725 million, which is 27% of the $117.5 million fund. These reports disagree, so we cannot give you one confirmed fee figure. See our guide to how class action settlements work.
What to Do Now
